The Government of Himachal Pradesh on September 01, 2026, issued the Himachal Pradesh Panchayati Raj (2nd Amendment) Bill, 2026, further to amend the Himachal Pradesh Panchayati Raj Act, 1994.
The following has been stated: -
•The Himachal Pradesh Panchayati Raj Act, 1994 has been amended to disqualify a person from Panchayat membership if they have encroached upon, or are a beneficiary of encroachment upon, government, municipal, Panchayat, cooperative society or village common land, unless six years have elapsed since eviction/cessation of encroachment.
•The definition of “beneficiary” includes the encroacher’s grandparents, parents, spouse, son, unmarried daughter and daughter-in-law.
•The same disqualification has been incorporated for the relevant provisions governing Panchayat membership.
•The Himachal Pradesh Panchayati Raj (Amendment) Ordinance, 2026 is repealed, while actions already taken under it are saved and deemed to have been taken under the corresponding provisions of the amended Act.
It shall be deemed to have come into force on May 06, 2026.
